Please read these Terms of Service and our Privacy Policy (collectively the “Terms”) carefully, as you agree to these Terms by using this website or Callee’s services, as described further below.
Acceptance of the Terms
The Terms are entered into by and between you (referred to herein as “you” and/or, if you have subscribed to Callee, as “Subscriber”) and Callee, Inc. (“Callee,” “we,” “our,” or “us”), and they govern your access to and use of the Callee website and/or Callee software (collectively the “Platform”) and Callee Services, as defined below, whether as a guest or subscriber.
Please read the Terms carefully before you start using the Platform or Services. By using the Platform, you accept and agree to be bound by these Terms of Service and our Privacy Policy, incorporated herein by reference. If you do not agree to these Terms of Service or the Privacy Policy, do not access or use the Platform or any Callee Services, but please get in touch with us so we can try to help.
Term
This agreement remains in full force and effect while you use the Platform. All provisions of the Terms shall survive termination by either party, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
Eligibility
The Platform and Services are intended only for access and use by individuals at least eighteen (18) years old. If you are not at least eighteen (18) years old, you are prohibited from both the access and usage of the Platform and Services.
Changes to the Terms
We may revise and update these Terms from time to time at our sole discretion. All changes are effective immediately when we post them and apply to all access to and use of the Platform and Services thereafter. Your continued use of the Platform or our Services following the posting of revised Terms means you accept and agree to the changes.
Services
Automated Call Answering Services
Callee provides automated call answering services, including Interactive Voice Response (IVR) systems and AI-powered assistants that route calls, take messages, qualify leads, and handle appointments. These services may include greeting callers, filtering spam calls, offering self-service options, and providing notifications to subscribers via text, email, or other means. Collectively, these services are called the “Services” in these Terms.
All plans are subject to, and limited by, Callee’s Reasonable Use Policy.
AI Call Answering Services
Callee offers AI-driven call answering services that use artificial intelligence to manage inbound calls, qualify leads, schedule appointments, and interact with customers. These services include call routing, message taking, spam call filtering, voicemail services, and appointment confirmations. All services provided by Callee are referred to as “AI Call Answering Services” in these Terms.
All plans are subject to, and limited by, Callee’s Reasonable Use Policy.
Outreach Services
Callee offers outreach services, including outbound calls for customer engagement, appointment booking, sales follow-ups, and caller feedback. These services are designed to help businesses engage with customers and are referred to as the “Outreach Services” in these Terms.
Administrative Services
At Subscriber’s request, Callee’s virtual receptionists may access your systems or online services to complete tasks, such as booking appointments or providing other information. You agree to provide Callee with the necessary credentials to perform these tasks securely. If access is denied or limited, Callee will not be responsible for failing to perform the requested administrative tasks.
Service Plans and Payment
Service Plans
Callee offers service plans on a subscription basis, including automated call answering services, AI call answering services, and outreach services. For more details on service plans and pricing, please visit Callee Pricing.
You may change your service plan at any time by notifying Callee’s support team. Changes will take effect on the next monthly billing cycle.
Payment Terms
Your subscription will automatically renew each month unless you cancel your service. All payments are non-refundable. You may change your service plan by contacting Callee at support@callee.com.
Callee reserves the right to charge for any overage incurred based on the limits of your plan. Payments will be automatically charged to the payment method provided during your subscription.
Restrictions on the Services
The following activities are prohibited when using the Platform or subscribing to the Services:
- Transmitting or causing the transmission of material that is derogatory, racist, abusive, threatening, obscene, hateful, or illegal.
- Using the Services for spamming or engaging in fraudulent activities.
- Reproducing, distributing, or modifying the Platform’s content without authorization.
- Interfering with the proper operation of the Platform.
Privacy and Confidentiality
Information We Collect
When you subscribe to the Services, Callee collects the following information:
- Personal Information: Name, email address, phone number, and other details you provide.
- Call Data: Information about inbound and outbound calls, messages, and call logs.
- Usage Data: Information about your use of the Platform, including device and browser information.
How We Use Your Information
We use the information we collect to provide the Services, improve the platform, and communicate with you. We will not sell your personal information to third parties.
Data Security
Callee implements industry-standard security practices, including encryption, to protect your data. However, no method of data transmission is completely secure, and we cannot guarantee the absolute security of your information.
Data Retention and Deletion
We retain your data for as long as necessary to provide the Services or as required by law. You can request to delete your personal information by contacting support@callee.com.
Cancellation and Termination
You may cancel your subscription at any time by contacting Callee’s support team. Upon cancellation, you will continue to have access to the Services until the end of the current billing cycle.
Callee may terminate or suspend your account if you violate these Terms or if payment is not made within 10 business days.
Indemnification
You agree to indemnify and hold harmless Callee, its affiliates, officers, and employees from any third-party claims, damages, or liabilities resulting from your use of the Services or any violation of these Terms.
Governing Law
These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. You consent to the exclusive jurisdiction of the courts located in Santa Clara County, California, for any legal disputes.
